同性婚姻合法 台湾亚洲第一 中国官民两样情

5月17日是“ 国际不再恐同日 ”,而台湾立法院也恰巧选在这天进行同婚草案的表决,保障同性两人可以办理结婚登记,成为全亚洲第一个同性婚姻合法的国家,中国大陆官方媒体则对这一进程保持沉默。s
台湾立法院表决各党团版本的同性婚姻专法,顺利採民进党团再修正动议版本三读通过,明定年满18岁的同性二人将可向户政机关办理 “ 结婚登记 ”,且可准用 “ 民法 ”继亲收养规定,专法于本月24日开始施行。台湾此次通过同志婚姻合法化,是30多年来同志平权团体及个人辛苦灌溉土壤,艰辛长成的果实。s
放眼亚洲,台湾曾一度是最接近同性婚姻可以实质合法化的国家,历经大法官释宪、大选和公投等摆盪,同性婚姻的法制化之路一直存在不同声音。s
台湾大法官曾在2017年5月24日释宪宣佈禁止同性结婚是违反宪法。使台湾成为亚洲第一个同性婚姻合法化的地区。主因 “ 台湾首位公开出柜的男同志 ”祁家威曾在1986年到台北地方法院公证处请求与一名男性公证结婚,遭到拒絶。他转而向立法院请愿,立法院以正式公文回应:“ 同性恋者为少数之变态,纯为满足情慾者,违背社会善良风俗 ”为由拒絶。2013年3月与男伴再度登记结婚被以《民法》规定必须 “ 一男一女 ”才能结婚为由再度遭到拒絶,经行政诉讼后败诉定谳。祁家威与台北市政府共同提出释宪。s
然而去年11月25日举行 “ 九合一选举”,也同时就十项议题进行公投,包括最具争议的 “ 你是否同意民法婚姻规定应限定在一男一女的结合?”,幸福盟提出的反同性婚姻3项公投案过关, 使得行政机关在3个月内提出保障同性婚姻的专法草案送交立法院审议,也就有了此次通过同志婚姻合法化的结果。s
台湾立法院表决通过同婚草案,消息一出外媒轰动,《路透》、《法新》、《美联》等通讯社、美国《CNN》、英国《BBC》、法国《世界报》等各大媒体无不争相报导这个 “ 台湾亚洲第一 ”的新闻。全世界媒体几乎都报导了台湾通过亚洲的第一部同性婚姻法案。s
相反的,中国大陆只有《人民日报》海外版提及这项法案。BBC报导,在中国,官方媒体广泛分享政府主要媒体发佈的报道是一个常规做法,但是除了一份报纸《新京报》和一本杂誌《Vista看天下》之外,传媒并没有在新浪微博上分享这条新闻。s
这一消息被低调处理,部分原因是北京将台湾视为 “ 一个中国 ”的一部分,而不是一个独立的国家或实体。中国不喜欢指出这个岛屿和大陆不一样的地方,而在同性婚姻这个案例上,就是不允许讨论为什麽它在台湾可以发生,而不是在中国。s
2017年3月台湾立法院通过同性婚姻法案,当时中国大陆也出现了呼吁订立同婚法的声音。但因北京与台湾的紧张关係,官方评论指出,台湾的这一法案是台湾领导人蔡英文作出的一个政治举动,为的是凸显台湾的民主、自由和人权与北京的严密控制有所不同。s
台湾在同性婚姻上独立自主的政治决定,年满18岁的台湾同性伴侣可依法登记结婚,但目前只能与同婚通过的国家公民结婚,大陆港澳伴侣也并未纳入专法。不过,对于中国人能不能与台湾人结为同志配偶,台湾陆委会已经宣布,只要同婚专法经立法院三读通过,将会研拟相关配套措施,依两岸人民关係条例、香港澳门关係条例进行修法。s
不官方媒体对于台湾的同性婚姻法案低调处理,却未阻止数十万用户使用「#台湾同性可以结婚了#」的标籤,这一次的中国社交媒体用户没有障碍地将他们的头像改成彩虹旗和转发「Love is Love(爱就是爱)」的口号,并且以前所未见的强度进行传播。s
网民在微博掀起热议,一度以228万的词条数量登上热搜榜第一名,截至下午5时左右,也仍以120多万的数量居于第四,阅读相关消息的人次至少超过4500万。关键字 “ 台湾同性可以结婚 ”登上热搜榜前5名,“ 台湾同性恋合法 ”标籤登上微博热搜榜,至晚间10点已有1.1亿阅读、5.2万讨论。不少中国网友大呼羡慕,更称这是 “ 人类文明的进步 ”。s
有中国网民政治化的恭贺 “ 中国的一省 ”终于走向同性婚姻合法,但更多中国网友表示:“ 台湾成为亚洲首个以法律保障同性婚姻的地区!”、“ 祝福你们、爱是自由的 ”、“ 我哭了 ”、“ 这真的是个太太太明智又理智的政策,愿所有爱与被爱的人得到理解和幸福”、“ 这是我们要学习的地方 ”。s
中国网友也羡慕的说:  “ 大陆的这一天什麽时候来?”、 “ 距离越来越远 ”、 “ 看看人家台湾,你默不作声,谁来为你争取权利呢?”、 “ 以后我就可以去台湾结婚了,太棒了!”、 “ 台湾做了人权带头 ”。s
不少网民在新浪微博转贴台湾新闻截图,配上“ 我爱你,无关性别,只是因为这个人刚刚好是你 ”、“ 爱没有对错,那性别也就没有对错 ”等网路金句。更多网民为此感到高兴,表示“ 好棒噢,祝有情人终成眷属 ”。也希望 “ 大陆法律愈来愈完善 ”、“ 希望大陆也不需要等太久 ”、“ 替国内的同性恋朋友羡慕下台湾的同性恋朋友 ”。s
就如同许多不清楚两岸问题的外国人,也有中国网民误解台湾同性婚姻合法话会对中国同性婚姻带来影响,有网民欢呼 “ 已经合法啦!谁歧视你们告他去 ”、“ 我觉得我们国家有希望了 ”。s
法国国际广播电台採访北京同志中心的负责人,他表示,“ 中国政府曾经在联合国表态,觉得同性婚姻并不适合我们的文化”,但他觉得台湾的同性婚姻合法化,其实也对中国文化给出了一个不一样的解释,就是说,“ 我们的中国文化还有很多的包容,有很大的空间可以往前走,可以接受新的东西,尤其是对中国来说,这有着更特殊的意义 ”。我觉得 “ 台湾同性婚姻合法化对整个中国可能都是曙光吧! ”s
许多网民热切期待中国政府也能跟上同婚合法,BBC分析,中国政府已意识到,近年国内对于同性婚姻法案已经有越来越多的支持,所以对同性恋权益採取更接纳的态度,某程度上有助于解决中国性别严重不平衡带来的不满——由于很多人在 “ 一胎政策 ”下选择不生育女孩,令中国目前的男性比女性多出几百万,从而令国家面对巨大的两性婚恋危机。不过,这又并不意味着,政府不会担心同性恋权利推广可能伤害传统的家庭价值观。s

不过,现在 “ 写BL小说要被关十年」、“ 男艺人戴耳环要被马赛克 ”、坊间还有许多“ 同性恋扭转治疗 ”机构的状况下,恐怕还有很长一段路要努力。s
