تونس: سجن القروي مأزق قانوني (دراسة)

أفضت قضية نبيل القروي المسجون والمرشح للدورة الثانية من الانتخابات الرئاسية إلى مأزق قانوني ودستوري لم تشهده تونس في تاريخها. إذ رفض قاضي التحقيق مجددا الأربعاء 18 سبتمبر/أيلول طلب الإفراج عنه معتبرا أن الأمر ليس من اختصاصه، ليكون بذلك ثالث جهة قضائية تلجأ إليها هيئة الدفاع ويرفض طلبها (بعد دائرة الاتهام ومحكمة التعقيب).

ويذكر أن القضاء التونسي قرر توقيف القروي قبل عشرة أيام من انطلاق الحملة الانتخابية على خلفية تهم تتعلق بتبييض أموال وتهرب ضريبي، إثر شكوى رفعتها ضده منظمة “أنا يقظ” غير الحكومية في العام 2017.

وحصل القروي على نسبة 15,58 بالمائة من الأصوات في الدورة الأولى، ليتواجه مع قيس سعيّد الذي حل أولا بـ18,4 بالمائة من الأصوات.

الأستاذ في القانون الدستوري سليم اللغماني والعضو في الهيئة العليا المستقلة للانتخابات عادل البرينصي يوضحان الغموض القانوني والدستوري الذي يلف القضية.

وحسب نزيه الصويهي المحامي لدى هيئة الدفاع عن نبيل القروي فإن القروي تحصل على أكثر من 500 ألف صوت في الدورة الأولى مكنته من الترشح للدورة الثانية للرئاسة على الرغم من أنه مسجون. وقال الصويهي في اتصال مع فرانس24 إن هيئة دفاع توجهت إلى ثلاث جهات قضائية لطلب الإفراج عنه إلا أن جميعها قالت إن الأمر ليس من اختصاصها. مع الإشارة إلى أنه حتى رئيس الجمهورية ليس بإمكانه إصدار عفو رئاسي عن القروي لأنه ليس هناك أي حكم قضائي صدر في حقه لحد الآن.

وأوضح الصويهي أن دائرة الاتهام هي الجهة التي وجهت لموكله بطاقة إيداع بالسجن نفذت خلال ساعتين فقط من إصدارها، وقبل عشرة أيام من بدء الحملة الانتخابية للرئاسيات: في 03 سبتمبر/أيلول قدم طلب بالإفراج لدى دائرة الاتهام إلا أنها رفضت ذلك بدعوى أنه ليس من اختصاصها.

في 13 سبتمبر/أيلول طلب آخر قدم لدى محكمة التعقيب التي رفضت بدورها ذلك بدعوى أنه ليس من اختصاصها كذلك.

في 17 سبتمبر/أيلول طلب ثالث قدم لدى قاضي التحقيق لكنه قوبل بالرفض مجددا في 18 سبتمبر/أيلول وبنفس المبرر.

استئناف قدم لدى دائرة الاتهام ينتظر الرد.

س: على ماذا ينص القانون التونسي في حال كان مرشح للدورة الثانية للانتخابات الرئاسية مسجونا؟

ج: سليم اللغماني أستاذ القانون الدستوري

“لأول مرة في تاريخها تواجه تونس هذا المأزق الدستوري، حتى أن الدستور الجديد الذي تمت صياغته عام 2014 بعد الثورة لا ينص على هذه الحالة غير المسبوقة”.

“فالدستور التونسي ينظر في حال استقال الرئيس أو تنحى أو أصيب بمرض مزمن أو توفي، لكنه لا يتطرق إلى مسألة السجن”.

“ونظرا لهذا الفراغ القانوني نأمل أن يتم الإفراج عن القروي وفق سراح شرطي على سبيل المثال”.

“وبما أن هيئة الدفاع سبق لها أن طلبت من ثلاثة جهات قضائية إطلاق سراحه إلا أن جميع طلباتها رفضت، أعتقد أن دائرة الاتهام التي وجهت إليه في البداية بطاقة الإيداع بالسجن هي فقط المؤهلة لإطلاق سراحه”.

س: في حال فاز القروي هل يجب قانونيا الإفراج عنه؟

ج: أستاذ القانون الدستوري سليم اللغماني

“يتضمن الفصل 87 من الدستور التونسي ما يلي ’يتمتع رئيس الجمهورية بالحصانة طيلة توليه الرئاسة، وتعلق في حقه كافة آجال التقادم والسقوط، ويمكن استئناف الإجراءات بعد انتهاء مهامه. لا يُسأل رئيس الجمهورية عن الأعمال التي قام بها في إطار أدائه لمهامه‘”.

“ويقرأ هذا النص وفق تأويلين، تقول القراءة الأولى إن رئيس الجمهورية المنتخب يتمتع بالحصانة القانونية بعد أداء اليمين الدستورية أمام البرلمان فيما تعتبر القراءة الثانية أن الرئيس المنتخب يتمتع بالحصانة فور التصريح بالنتائج النهائية من قبل الهيئة العليا المستقلة للانتخابات”.

“رؤيتي الخاصة أقرب للقراءة الثانية، أي أن الرئيس المنتخب يتمتع بالحصانة الدستورية مباشرة بعد إعلان نتائج الدورة الثانية من الانتخابات الرئاسية من قبل الهيئة المستقلة للانتخابات، وبناء على ذلك إذا فاز نبيل القروي بمنصب الرئاسة فإنه يتمتع بالحصانة القانونية وبإمكانه مغادرة السجن للقيام بمهامه كرئيس منتخب”.

“ويغادر القروي في هذه الحالة السجن بناء على قرار قضائي، أي أنه لن يكون من الضروري انتظار صدور حكم أو إجراء تحقيق، بل تتم معاينة قضائية تفضي إلى أن هذا الشخص منتخب كرئيس ويتمتع بالحصانة، عندها تعلق التتبعات القضائية في حقه”.

“القراءة الأولى للفصل 87 تفيد بأن الشخص المنتخب لا يصبح رئيسا إلا إذا أدى اليمين الدستورية أمام البرلمان، وقبل ذلك فإنه لا يتمتع بالحق في الحصانة”.

“وبناء على هذه القراءة ليس بإمكان القروي الخروج من السجن مباشرة بعد إعلان النتائج حتى وإن فاز بأغلبية الأصوات، لكن يجب أن ينتظر أداء اليمين الدستورية أمام البرلمان”.

“وللفصل في هذا الإشكال القانوني، كان من المفترض اللجوء للمحكمة الدستورية لاختيار إحدى القراءتين للقانون. والمحكمة الدستورية وحسب الفصل 120 من الدستور، هي الوحيدة المخول لها مراقبة دستورية القوانين”.

“إلا أن تعيين أعضاء هذه الهيئة تأخر إلى اليوم، وينص الدستور التونسي على ضرورة تشكيل المحكمة الدستورية في أجل أقصاه سنة بعد الانتخابات التشريعية التي أجريت في 2014، غير أن الكتل البرلمانية لم تتمكن من انتخاب سوى عضو واحد وهي امرأة، في مارس آذار 2018 من أصل أربعة أعضاء”.

س: إذا فاز قيس سعيّد وتقدم القروي بطعن في النتائج بناء على عدم احترام مبدأ تكافؤ الفرص ماذا يقول القانون؟

ج: عادل البرنيصي العضو في الهيئة العليا للانتخابات

“من الوارد جدا أن يطعن القروي على أساس مبدأ تكافؤ الفرص في نتائج الدورة الثانية إذا فاز منافسه قيس سعيّد”.

“وإذا حصل ذلك سيلجأ القروي إلى المحكمة الإدارية للطعن في قرار الهيئة العليا المستقلة للانتخابات. وفي هذه الحالة يمكن أن تحكم المحكمة الإدارية لصالحه بإلغاء النتيجة وبإعادة الانتخابات. وهذا أسوأ السيناريوهات المحتملة”.

والمحكمة الإدارية هي محكمة دستورية قضائية مخولة بالنظر في مسألة الطعون بشأن نتائج الانتخابات.

وبالتالي فإن السيناريوهات المحتملة لنتائج الانتخابات الرئاسية في تونس تفضي إلى مآزق قانونية ودستورية قد تكون سببا في إعادة الانتخابات.

وتسعى الهيئة العليا المستقلة للانتخابات لتفادي هذا الاحتمال، إذ وجه رئيس الهيئة نبيل بفون الخميس طلبا لقاضي التحقيق للسماح للقروي بالقيام بحملته الانتخابية مع احترام مبدأ تكافؤ الفرص.
